DWI
Occupational Licenses/Hardship Licenses (ODL)
If your license has been suspended because of a DWI, as your attorney I can help you to obtain an occupational license which will allow you to go to work and take care of essential household needs. These licenses require you to purchase a special type of insurance coverage called an SR22.
Occupational drivers licenses have special rules pertaining to when you have received a previous DWI. If you have been charged with a previous DWI, it is absolutely critical to contact me well within the “15 day rule.”
For more information on how we can help you obtain such a license, please visit our Texas Occupational Driver License page.
Did a recent breath analyzer failure lead to the revocation of your license and without a means to get to your job? Contact me immediately if you have experienced a breath analyzer failure because the administrative license suspension process will take place immediately but the process of obtaining an occupational license takes some time.
You have only 15 days from the day of your DWI arrest to challenge the automatic suspension of your license.
In addition to the time it takes for the civil arm of the district attorney‘s office to clear the case, the courts also require sufficient time to process these cases. You and I have to get the SR22, and then I need time to draft up the verified petition and affidavit. These documents are case specific based on what your work hours and essential household needs are.
Our law firm can represent you during ALL DWI-related hearings, including your administrative license revocation (ALR) hearing. We can also work to help you obtain an occupational or temporary license so you can get to and from work or school.I represent clients in the county criminal courts and in the administrative license revocation (ALR) hearings. I also represent clients in the county court at law hearings which grant occupational licenses.
There are several challenges available on DWI cases including the reliability of the Intoxilizer 5000, a breath analysis device employed by many police departments. There are also more traditional probable cause defenses which can be used to challenge the stop or the arrest. Sometimes police surveillance video can be used in this regard to show that the field sobriety test was itself invalid and therefore did not create probable cause for the arrest. A motion to suppress is the legal method used to challenge such a stop or illegal arrest.

Driving With License Suspended (DWLS)
DWLS is a misdemeanor that can be avoided by getting an occupational license. I defend these cases on a flat fee basis.
Driving While License Invalid (DWLI)
DWLI is an offense covered by the Texas Transportation Code. If your license is invalid I can probably get you an occupational license to avoid you picking up a second offense which is a more serious class A misdemeanor. I defend these case on a flat fee basis.
